Sharia Law

Shariah law

Sharia law is the law of Islam. The Sharia (also spelled Shariah or Shari’a) law is cast from the actions and words of Muhammad, which are called “Sunnah,” and the Quran, which he authored.

The Sharia law itself cannot be altered, but the interpretation of the Sharia law, called “figh,” by imams is given some leeway.

As a legal system, the Sharia law covers a very wide range of topics. While other legal codes deal primarily with public behavior, Sharia law covers public behavior, private behavior and private beliefs. Of all legal systems in the world today, Islam’s Sharia law is the most intrusive and strict, especially against women.

According to the Sharia law:

•  Theft is punishable by amputation of the right hand (above).
•  Criticizing or denying any part of the Quran is punishable by death.
•  Criticizing or denying Muhammad is a prophet is punishable by death.
•  Criticizing or denying Allah, the moon god of Islam is punishable by death.
•  A Muslim who becomes a non-Muslim is punishable by death.
•  A non-Muslim who leads a Muslim away from Islam is punishable by death.
•  A non-Muslim man who marries a Muslim woman is punishable by death.
•  A man can marry an infant girl and consummate the marriage when she is 9 years old.
•  Girls’ clitoris should be cut (per Muhammad‘s words in Book 41, Kitab Al-Adab, Hadith 5251).
•  A woman can have 1 husband, but a man can have up to 4 wives; Muhammad can have more.
•  A man can unilaterally divorce his wife but a woman needs her husband’s consent to divorce.
•  A man can beat his wife for insubordination.
•  Testimonies of four male witnesses are required to prove rape against a woman.
•  A woman who has been raped cannot testify in court against her rapist(s).
•  A woman’s testimony in court, allowed only in property cases, carries half the weight of a man’s.
•  A female heir inherits half of what a male heir inherits.

•  Meat to be eaten must come from animals that have been sacrificed to Allah – i.e., be Halal.

Wisconsin Gov. Scott Walker has suspended his presidential campaign, effectively ending a once-promising GOP presidential bid that collapsed amid tepid debate performances, confusing statements and other missteps.

“Today, I believe that I am being called to lead by helping to clear the field in this race so that a positive, conservative message can rise to the top of the field,” Walker said in a brief speech in Madison, Wisconsin, on Monday evening. “With this in mind, I will suspend my campaign immediately.”

Walker said that because the field is so crowded, candidates have become focused on personal attacks instead of the substantial issues that matter most to voters. He said Republicans have lost the “optimistic view of America” pushed by President Ronald Reagan, Walker’s political idol, and urged those still running to “get back to the basics” with a focus on creating jobs, reducing the size of government and strengthening the military.

“To refocus the debate on these types of issues will require leadership,” Walker said. “I encourage other Republican presidential candidates to consider doing the same so that the voters can focus on a limited number of candidates who can offer a positive, conservative alternative to the current front-runner. This is fundamentally important to the future of the party and, more importantly, to the future of our country.”

In making that plea, Walker did not directly name the current front-runner, businessman Donald Trump.

The announcement stunned many of Walker’s major supporters, donors, fundraisers and even some of his staff members. Given his tanking poll numbers, many expected dramatic changes to the staff and strategy — but not such a sudden end.

“I’m stunned and saddened because I think Scott has had a tremendous record of accomplishment,” Fred Malek, a longtime party fundraiser who serves as the Republican Governor’s Association’s finance chairman. “He’s a man of the highest character and capacity, and he would have made a great president.”
Wisconsin State Assembly Speaker Robin Vos said in a statement: “Governor Walker has an amazing story to tell about turning Wisconsin around. It is unfortunate that the bluster of candidates overshadowed his substance.”

When Walker launched his presidential campaign in mid-July, he was considered a top-tier candidate. He was an early favorite in Iowa, where many voters liked that he was a mellow, understated and sometimes boring Midwesterner. And a super PAC supporting his candidacy raised more than $20 million in less than three months.

But as the summer wore on, Walker’s campaign quickly became overshadowed by Trump and other candidates who have never held elected office. As Walker slid in early polls, he seemed to struggle to find his place the field, sometimes taking stances or using language that confused some of his longtime supporters. During the first Republican debate, Walker pitched himself as “aggressively normal” but seemed to disappear on the crowded stage. While he tried to be more energetic during the second debate last week, Walker was again overshadowed and hardly spoke during the three-hour faceoff. There were always glimmers of hope within the campaign that the situation would improve, and Walker’s campaign was constantly maneuvering — first targeting Trump’s supporters, then trying to tap into anti-establishment sentiments and then, just last week, focusing all of their energy on Iowa.

Throughout the summer, Walker made a series of confusing or contradictory comments that often took several days to fully clarify. In August, he seemed to endorse ending birthright citizenship, then said he didn’t have a position on the issue, and then said that he did not want to change the constitution, which many believe guarantees citizenship to those born on U.S. soil. In late August, Walker called building a wall along the Canadian border “a legitimate issue for us to look at,” only to say days later that he never supported the idea and that his words were twisted by the media. Over Labor Day weekend, he refused to say if the United States should accept more Syrian refugees, telling reporters that it was a “hypothetical question” and that he wanted to talk about “reality” – only to say soon after that the United States should not accept more refugees.
Several longtime Walker supporters said they no longer recognized the candidate they had watched rise to national prominence from the Wisconsin governor’s office. Walker is best known for aggressively pushing for reforms to the state’s public-sector unions in 2011, riling Democrats both in his state and across the country. He quickly became a favorite of tea-party activists and his calm amid protests at the state capitol landed him on the cover of conservative magazines. He became a regular presence on Fox News. A year later, as he battled and ultimately won a recall election, he was being touted as a possible vice-presidential candidate for GOP nominee Mitt Romney.

“It was nice for him to get that attention in the short run, but it set up expectations he couldn’t hope to maintain,” said Vin Weber, a former Minnesota congressman and adviser to Jeb Bush’s presidential campaign.

Union leadership, which had long considered Walker a top target, reacted quickly Monday to reports that he was suspending his campaign. “Scott Walker is still a disgrace, just no longer national,” AFL-CIO president Richard Trumka said in a terse afternoon statement.

In recent weeks, there were clear signs that Walker’s campaign was in trouble. His poll results began to resemble a ski slope. And although the super PAC was flush with money, supporters worried that the campaign itself was running low on cash.

The large cadre of staff and paid consultants around Walker have been on what one called a “death watch” for the past several weeks. It was clear to many that a single bad debate performance would spell the beginning of a dramatic downsizing of Walker’s campaign, with Walker staffers bracing for spending cuts, layoffs and a shake-up in the campaign leadership. Following last week’s debate, the frustration of many fundraisers and major donors exploded, as they demanded that Walker replace his campaign manager, Rick Wiley. Over the weekend, Walker skipped two previously scheduled appearances in Michigan and California, angering Republicans in states with high numbers of delegates, so that he could instead spend more time in Iowa. There, he struck several people as looking exhausted and beaten down.
There aren’t many loyal Walker voters in the state left to claim, said Steve Grubbs, Iowa strategist for Republican presidential rival Rand Paul. “The reality is that there was a very significant shift from Walker to Trump over the last 8-10 weeks,” he said, adding that it was those voters who might be up for grabs. “As Walker is out, and Trump begins to lose support, those voters will come back into play. And we believe that a lot of those voters are gettable,” said Grubbs.

Then came the latest CNN poll on Sunday that was like a punch in the gut: The governor was now polling nationally at less than one percent – so low that he received an asterisk on some charts instead of an actual number.

Still, the candidate kept his deliberations to quit the race very close, with a full schedule of events planned for this week that included campaign stops in Indiana and Virginia and a fundraiser in New York City at the home of one of his major donors, Joe Ricketts. Most staff, including senior aides, found out only Monday that he had decided to suspend his campaign later in the day.

Walker said on Monday that he reflected on the decision at church on Sunday. In suspending his campaign, he thanked everyone who believed in him — especially his wife, Tonette, and their two sons.

“Most of all, I want to thank God for his abundant grace,” Walker said in closing on Monday. “Win or lose, it is more than enough for any of us.”

Trump — who has been credited with quickening if not causing the sudden death of Walker’s campaign — praised Walker’s character and gubernatorial record and said he would reach out to his former rival in the coming days to offer encouragement.

“I really liked him a lot,” Trump said in an interview with The Washington Post on Monday. “I thought he was a terrific person. He has been a terrific governor. I got to know him pretty well. I’m a little surprised that it hasn’t worked out better for him. Many people thought he’d be the primary competition, at least initially.”
Trump, who proudly surrounds himself with a small group of aides, wondered if Walker was hurt by too much advice and management from his political consultants. “He was very loose guy when he came up to see me a few months ago to give me a plaque, but then on the campaign, maybe there were too many people. I think he had too many people, many of them who didn’t know what they were doing,” he said.

Other presidential contenders also offered their praise on Monday evening. In a statement, Sen. Ted Cruz (R-Tex.) called Walker “a good man, a formidable fighter, and an effective reformer.” Sen. Marco Rubio (R-Fla.) also used a statement to call Walker “a good man” and “one of the best governors in the country.”

Even before Walker announced the suspension of his campaign, rival campaigns had begun contacting top Walker donors to urge them to come aboard. Vin Weber said Bush’s campaign was aggressively reaching out to Walker donors and staffers Monday afternoon. “We thought it happened a little sooner than expected, but it was inevitable. There was not a path back for him, based on his performance as a candidate. And even though he was an asterisk in the polls, his decision will help to clarify the race, sending a strong message to other candidates who aren’t registering to move on and get the party down to 5 or 6 candidates who are viable.”

Gary Marx, a senior adviser to Walker’s campaign who coordinated outreach to conservative movement groups, said in an interview Monday that he and others are already looking for work. On Tuesday, Marx said, he will interview with three GOP presidential campaigns, which he declined to name.

A major problem of the Walker campaign, he said, was that it was difficult to generate enthusiasm — and campaign funding soon dried up. “No matter how much money was in the super PAC, hard dollars still matter,” he said. “He didn’t have the finances to continue on. Money is ultimately what stops campaigns from going further.”

Obama’s New Delay of Employer Mandate Violates Plain Language of Law –

President Barack Obama’s Treasury Department issued a new  regulation today that for the second time directly violates the plain and unambiguous text of the Patient Protection and Affordable Care Act by allowing some businesses to avoid the law’s Dec. 31, 2013 deadline to provide health insurance coverage to their employees.

Initially, on July 2, 2013, the administration unilaterally delayed the deadline for the employer mandate until 2015. Now, the administration is unilaterally delaying it for some businesses until 2016.

In its official summary of PPACA, the Congressional Research Service said: “(Sec. 1513, as modified by section 10106) Imposes fines on large employers (employers with more than 50 full-time employees) who fail to offer their full-time employees the opportunity to enroll in minimum essential coverage or who have a waiting period for enrollment of more than 60 days.”

The text of the law itself describes an “applicable large employer” as follows: “The term ‘applicable large employer’ means, with respect to a calendar year, an employer who employed an average of at least 50 full-time employees on business days during the preceding calendar year.”

The final words in the section of PPACA mandating that employers with more than 50 full-time employees provide their employees with “minimum essential coverage” imposes a specific statutory deadline for doing so. It says: “EFFECTIVE DATE.—The amendments made by this section shall apply to months beginning after December 31, 2013.”

Last summer, the administration unilaterally moved this hard statutory deadline back one year to 2015 for all employers with more than 50 full-time employees. Now, without any action by Congress, the administration is moving it back again for some employers—despite the plain language of the law.

The Treasury Department has issued a fact sheet explaining how the Obama administration’s new declaration changes the meaning of the Patient Protection and Affordable Care Act.

The fact sheet says:

“To ensure a gradual phase-in and assist the employers to whom the policy does apply, the final rules provide, for 2015, that: The employer responsibility provision will generally apply to larger firms with 100 or more full-time employees starting in 2015 and employers with 50 or more full-time employees starting in 2016.”

The fact sheet goes on to say:

“To avoid a payment for failing to offer health coverage, employers need to offer coverage to 70 percent of their full-time employees in 2015 and 95 percent in 2016 and beyond, helping employers that, for example, may offer coverage to employees with 35 or more hours, but not yet to that fraction of their employees who work 30 to 34 hours.”

It further says:

“While the employer responsibility provisions will generally apply starting in 2015, they will not apply until 2016 to employers with at least 50 but fewer than 100 full-time employees if the employer provides an appropriate certification described in the rules.”

And also:

“Employers that are subject to the employer responsibility provisions in 2015 must offer coverage to at least 70 percent of full-time employees as one of the conditions for avoiding an assessable payment, rather than 95 percent which will begin in 2016.”

In sum, the law says that employers with “at least 50 full-time employees” must provide “minimum essential coverage” in the “months beginning after December 31, 2013” or pay a fine. The new declaration from the Obama administration’s Treasury Department says this part of the law no longer applies. It says employers with between 50 and 99 employees need not provide coverage until 2016 and larger employers need only provide coverage to 70 percent of their employees next year.

Obama Delays Health-Care Mandate for Some Companies–Update

A batch of employers won’t face a fine next year if they fail to provide health insurance to their workers, the Obama administration said Monday.

In regulations outlining the Affordable Care Act, the Treasury Department said employers with between 50 and 99 full-time workers won’t have to comply with the law’s requirement to provide insurance or pay a fee until 2016.

Companies with 100 workers or more could avoid penalties in 2015 if they showed they were offering coverage to at least 70 percent of their full-time workers, the Treasury said.

The move is a new, significant revision of the law after a series of delays and a troubled rollout. Originally, employers with the equivalent of 50 full-time workers or more had to offer coverage or pay a penalty starting at $2,000 per worker beginning in 2014.

That so-called employer mandate was seen as a cornerstone provision in the law’s goal of expanding insurance coverage to millions of Americans this year. But last summer the administration announced a surprise one-year reprieve in enforcement of the requirement, from 2014 to 2015.

Monday’s announcement of further delays comes as the administration weighs how much of the law to adjust in the wake of the rollout and the looming prospect of midterm elections.

A senior administration official said the shift reflects the administration’s observations on the law’s implementation and its willingness to acknowledge business concerns, though the official said that no single reason was behind the change.

Most large employers offer coverage to their workers, though not all employees accept it. Many of the companies that don’t offer coverage have fewer employees and are in lower-wage areas such as the hospitality, retail and agriculture sectors. They have been among the most vocal about the impact of the new requirements.

Some of those employers had begun trimming workers’ hours as a way to reduce their exposure to penalties, since the requirement to cover workers only applies to employees clocking 30 hours a week or more.

The administration also signaled on Monday that big employers that currently offer coverage voluntarily will likely see simpler requirements for how to prove that. However, full regulations detailing the reporting requirements haven’t been released, senior Treasury officials said.

Under the new rules, companies would be allowed during the phasing-in year to offer coverage specifically to a subset of employees, such as those working 35 hours or more a week, the Treasury said.

Senior Treasury officials said the shift was aimed at giving more time for smaller employers subject to the requirement to adjust and for all companies to consider the number of hours their employees worked and whether they could avoid cutting them.

The officials said employers who wanted to use the phase-in period would have to certify that they hadn’t decreased their employee numbers in order to qualify.

Treasury also set new rules for how the requirement would apply to workers such as volunteers and seasonal employees, saying that employers wouldn’t be penalized for failing to offer those people coverage, regardless of the number of hours they were working.

In recent months the administration has made a series of changes to the law that have further blunted its full impact this year. It has asked insurers to temporarily reinstate policies that had been canceled because they didn’t meet new requirements set by the law, even though the administration had previously described those plans as inadequate.

The botched launch of online insurance portals also prompted the Congressional Budget Office to revise its estimates for the number of people who would use the exchanges this year to 6 million, as well as another 8 million people who would gain coverage by signing up for Medicaid.

Immigration law: an overview

“…Federal immigration law determines whether a person is an alien, the rights, duties, and obligations associated with being an alien in the United States, and how aliens gain residence or citizenship within the United States. It also provides the means by which certain aliens can become legally naturalized citizens with full rights of citizenship. Immigration law serves as a gatekeeper for the nation’s border, determining who may enter, how long they may stay, and when they must leave.

Congress has complete authority over immigration. Presidential power does not extend beyond refugee policy. Except for questions regarding aliens’ constitutional rights, the courts have generally found the immigration issue as nonjusticiable.

States have limited legislative authority regarding immigration, and 28 U.S.C. § 1251 details the full extent of state jurisdiction. Generally, 28 U.S.C. § 994 details the federal sentencing guidelines for illegal entry into the country.

By controlling the visa process, the federal government can achieve the goals of its immigration policies.  There are two types of visas: immigrant visas and nonimmigrant visas. The government primarily issues nonimmigrant visas to tourists and temporary business visitors. The government divides nonimmigrant visas into eighteen different types, but for most types, does not impose a cap on the number that may be granted in a year. Only a few categories of non-immigrant visas allow their holders to work in the United States. Immigrant visas, on the other hand, permit their holders to stay in the United States permanently and eventually to apply for citizenship. Aliens with immigrant visas can also work in the United States. Congress limits the quantity of immigrant visas, which numbered 675,000 in 1995. Many immigrant visas remain subject to per-country caps.

Early history of American immigration law

Congress’s first attempt to set immigration policy came in 1790 with the enactment of the Naturalization Act of 1790.  This Act restricted naturalization to “free white persons” of “good moral character” and required the applicant to have lived in the country for two years prior to becoming naturalized.  In 1795 an amendment increased the residency requirement to five years.  The five-year requirement remains on the books to this day.

Upon ratification of the Fourteenth Amendment, all children born within the United States received citizenship at birth.  In 1870 Congress broadened naturalization laws to allow African-Americans the right to become naturalized citizens.  Asian Americans, however, did not receive such a right for many years.  Xenophobia from an influx of Asians between 1850 and 1882 prompted Congress to pass the Chinese Exclusion Act, which restricted further Chinese immigration.

In 1921 Congress passed the Emergency Immigration Act, creating national immigration quotas, which gave way to the Immigration Act of 1924, capping the number of permissible immigrants from each country in a manner proportional to the number already living within the United States.  The aggregate number from the eastern hemisphere could not eclipse 154,227 immigrants.  Franklin D. Roosevelt’s Administration essentially closed to the country to immigration essentially during the Great depression, drastically reducing the numbers per country that could enter the United States.

Modern immigration law

The Immigration and Nationality Act of 1952 (INA), also known as the McCarran-Walter Act, eliminated all race-based quotas, replacing them with purely nationality-based quotas.  The INA continues to influence the field of American immigration law.  To enforce the quotas, the INA created the Immigration and Naturalization Service (INS).  The INS served as the federal agency that enforced these caps for remainder of the 20th century.

When Congress passed the INA, it defined an “alien” as any person lacking citizenship or status as a national of the United States. Different categories of aliens include resident and nonresident, immigrant and nonimmigrant, and documented and undocumented (“illegal”). The terms “documented” and “undocumented” refer to whether an arriving alien has the proper records and identification for admission into the U.S.  Having the proper records and identification typically requires the alien to possess a valid, unexpired passport and either a visa, border crossing identification card, permanent resident card, or a reentry permit.  The INA expressly refuses stowaway aliens entry into the U.S.

The need to curtail illegal immigration prompted Congress to enact the Immigration Reform and Control Act (IRCA) of 1986. The IRCA toughened criminal sanctions for employers who hired illegal aliens, denied illegal aliens federally funded welfare benefits, and legitimized some aliens through an amnesty program. The Immigration Marriage Fraud Amendments of 1986 sought to limit the practice of marrying to obtain citizenship. The Immigration Act of 1990 thoroughly revamped the INA by equalizing the allocation of visas across foreign nations, eliminating archaic rules, and encouraging worldwide immigration.

The Illegal Immigration Reform and Immigrant Responsibility Act (IIRIRA) of 1996 revolutionized the process of alien entry into the United States.  The IIRIRA eliminated the term “entry,” replacing it with “admission.”  An application for admission occurs whenever an alien arrives in the U.S. regardless of whether the arrival occurs at a designated port-of-entry. Applicants at either designated ports or otherwise must submit to an inspection by U.S. customs, even if the applicant possesses an immigrant visa.  The IIRIRA also employs the term “arriving alien” to describe applicant aliens attempting to enter the U.S., regardless of whether they arrive at a designated port, a non-designated point on the border, or are located in U.S. waters and brought to shore.

Post-9/11 reform

On March 1, 2003, the Department of Homeland Security opened, replacing the INS.  The Bush Administration had designed the Department of Homeland Security to foster increased intelligence sharing and dialogue between agencies responsible for responding to domestic emergencies, such as natural disasters and domestic terrorism.  Within the Department, three different agencies – U.S. Customs and Border Enforcement (CBE), U.S. Citizenship and Immigration Services (USCIS), and U.S. Immigration and Customs Enforcement (ICE) – now handle the duties formerly held by the INS.  Currently, the CBE handles the INS’s border patrol duties, the USCIS handles the INS’s naturalization, asylum, and permanent residence functions, and the ICE handles the INS’s deportation, intelligence, and investigatory functions.

Refugee and asylum seekers

The Refugee Act of 1980 defines the U.S. laws relating to refugee immigrants.  Under the Refugee Act, the term “refugee” refers to aliens with a fear of persecution upon returning to their homelands, stemming from their religion, race, nationality, membership in certain social groups, or political opinions.  Anyone who delivers a missing American POW or MIA soldier receives refugee status from the United States.

The United States, however, denies refugee status to any alien who actively persecuted individuals of a certain race, political opinion, religion, nationality, or members of a certain social group.   As a matter of public policy, the government also typically refuses refugee applicants previously convicted of murderer.   For refugees who have “firmly resettled” in another country, the United States will deny a request for refugee admission.  The government considers refugees “firmly resettled” if the refugees have received an offer of citizenship, permanent residency, or some other permanent status from a foreign country.

Under international law, the Geneva Convention, or the laws of the United States, foreign citizens who have become disillusioned with their homeland cannot take temporary refuge within the United States.  The Refugee Act of 1980 specifically leaves out temporary refuge as a form of refugee status that the U.S. government will recognize.

To qualify for refugee status under the persecution provision, the refugee applicant must prove actual fear.  A proof of actual fear requires meeting both a subjective and an objective test.  The subjective test requires that the refugee actually have an honest and genuine fear of being persecuted for some immutable trait, such as religion, race, and nationality.  Seekers of asylum must show a fear that membership in a social or political group has caused past persecution or has caused a well-founded fear that persecution will occur upon returning.  The applicant meets the objective standard by showing credible and direct evidence that a reasonable possibility of persecution exists upon the applicant’s return to the homeland.

The President retains the ultimate decision making authority when determining the number of refugees to allow into the country during a given year.

Deportation

Deportation refers to the official removal of an alien from the United States.  The U.S. government can initiate deportation proceedings against aliens admitted under the INA that commit an aggravated felony within the United States after being admitted.  An alien’s failure to register a change of address renders the alien deportable, unless the failure resulted from an excusable circumstance or mistake.  If the government determines that a particular alien gained entry into the country through the use of a falsified document or otherwise fraudulent means, the government has the grounds to deport.

Other common grounds for deportation include the following: aiding or encouraging another alien to enter the country illegally; engaging in marriage fraud to gain U.S. admission; participating in an activity that threatens the U.S.’s national security; voting unlawfully; and failing to update the government with a residential address every three months, regardless of whether the address has changed.  The last of these policies served as the grounds for the government to deport 2,000 Pakistanis following the September 11th attacks.

If the government brings a proceeding for deportation because of fraud or falsification, the government bears the burden of proving by clear and convincing evidence that alleged falsification or fraud occurred and that the falsification or fraud proved material to the granting of admission to the alien.  Upon such a proof, the government has established a rebuttable presumption that the alien gained admission through material falsification or fraud.  To rebut the presumption, the alien must demonstrate by a preponderance of the evidence that admission would have been granted even without the falsification or fraud. …”

Three myths about the detention bill

“…Condemnation of President Obama is intense, and growing, as a result of his announced intent to sign into law the indefinite detention bill embedded in the 2012 National Defense Authorization Act (NDAA). These denunciations come not only from the nation’s leading civil liberties and human rights groups, but also from the pro-Obama New York Times Editorial Page, which today has a scathing Editorial describing Obama’s stance as “a complete political cave-in, one that reinforces the impression of a fumbling presidency” and lamenting that “the bill has so many other objectionable aspects that we can’t go into them all,” as well as from vocal Obama supporters such as Andrew Sullivan, who wrote yesterday that this episode is “another sign that his campaign pledge to be vigilant about civil liberties in the war on terror was a lie.” In damage control mode, White-House-allied groups are now trying to ride to the rescue with attacks on the ACLU and dismissive belittling of the bill’s dangers.

For that reason, it is very worthwhile to briefly examine — and debunk — the three principal myths being spread by supporters of this bill, and to do so very simply: by citing the relevant provisions of the bill, as well as the relevant passages of the original 2001 Authorization to Use Military Force (AUMF), so that everyone can judge for themselves what this bill actually includes (this is all above and beyond the evidence I assembled in writing about this bill yesterday):

Fascism opposes class-based identity and society, it is thus both anti-bourgeois and anti-proletarian; and individualist based identity and society.[12] It is opposed to many ideologies, including conservatism, liberalism, and two major forms of socialism: communism and social democracy.[13] It opposes a variety of economic, political and social systems, it is opposed to democracy, parliamentary systems, is anti-clerical, and holds a distinctive opposition to capitalism.[14] It rejects egalitarianism, materialism, and rationalism in favour of action, discipline, hierarchy, spirit and will.[15]

In economics, fascists oppose economic liberalism (as a bourgeois movement) and Marxism (as a proletarian movement) for being class-based movements.[16] Fascists present their ideology as that of an economically trans-class movement that advocates resolving economic class conflict to secure national solidarity.[17] Fascists advocate: a state-directed, regulated economy that is dedicated to the nation; the use and primacy of regulated private property and private enterprise contingent upon service to the nation or state; the use of state enterprise where private enterprise is failing or is inefficient; and autarky.[3] They are hostile to finance capitalism, plutocracy, the “power of money”, and internationalist economics.[3]

Fascism was founded during World War I by Italian national syndicalists who combined left-wing and right-wing political views, but Italian fascism gravitated to the right in the early 1920s.[18][19] Italian Fascists described fascism as a right-wing ideology in the political program The Doctrine of Fascism: “We are free to believe that this is the century of authority, a century tending to the ‘right,’ a fascist century.”[20][21] However they also officially declared that although they were “sitting on the right” they were generally indifferent to their position on the left-right spectrum, as being a conclusion of their combination of views rather than an objective, and considering it insignificant to their basis of their views that they claimed could just as easily be associated with “the mountain of the center” as with the right.[22] There is a running dispute among scholars about where along the left/right spectrum that fascism resides.[23][24][25][26] …”

Mexican President Felipe Calderon began his state visit to the White House this morning with a shot at the Arizona immigration law and a plea for continental solidarity against organized crime.Calderon drew applause from the crowd gathered on the South Lawn at the arrival ceremony when he said too many Mexican immigrants are “still living here in the shadows with such laws as the Arizona law that is placing our people to face discrimination.” In his remarks, President Obama hailed the “Mexican-American families [who] have been here for centuries.” He said immigrants “strengthen our American family.” He appealed to Calderon to work with him to “ensure that our common border is secure, modern and efficient, including immigration that is orderly and safe.”

It also asks respondents the same demographic questions in each poll:  What is your education level?  What is your age?  What is your religious affiliation?  What is your marital status?  Question D3 asks respondents to describe their ideology.  The choices are “very conservative,” “somewhat conservative,” “moderate,” “somewhat liberal,” “very liberal,” and “unsure/refused.”  Those asked by the Battleground Poll — if they dislike the liberal label — can call themselves moderates,  they can refuse to answer, and  they can express an uncertainty about their ideology.   Only those certain of their ideology and willing to label themselves are considered conservative in the poll.

The Battleground Poll is not a Republican polling organization.  It is, rather, one of the few bipartisan polling organizations.  Republican and Democrat pollsters agree on the language of the questions for respondents, so that the questions asked are not only fairly worded, but unusually fairly worded.  Republican and Democrat pollsters agree on the population sample, so that polls results are not skewed because too many Democrats, too many Republicans, or too many independents are included.  The Battleground Poll also has proven very accurate over many elections.

 

The responses to Question D3 have been remarkably consistent.  Respondents have changed dramatically about what they thought of President Bush or of the state of the economy or the most important issues facing our nation.  Respondent may swing quite a bit about which party they support or trust the most.  But in one single area of this long list of polling data, the American people have not wavered at all from Battleground Poll to Battleground Poll:  About sixty percent of the American people, in poll after poll, year after year, describe themselves as “conservative.”

 

On December 16, 2009, Battleground released its latest poll.  In this poll, 63% of the American people described themselves as “very conservative” or “somewhat conservative.”  The rest of America – not just liberals, but moderates and people who were unsure about their ideology or chose not to respond to that question, totaled, collectively, only 37% of America.  A measly one percent of Americans called themselves moderates; 25% of Americans called themselves “somewhat liberal,” and 8% of Americans called themselves “very liberal.”  …”

66% Favor Smaller Government With Fewer Services, Lower Taxes

“…Sixty-six percent (66%) of U.S. voters prefer a smaller government with fewer services and lower taxes over a more active government with more services and higher taxes.

That’s the second highest finding of the year: In August at the height of the congressional town hall controversies over the health care plan, 70% felt that way.

A new Rasmussen Reports national telephone survey finds that just 22% prefer a government with more services and higher taxes. Eleven percent (11%) aren’t sure which is best.

Eighty-eight percent (88%) of Republicans and 63% of voters not affiliated with either major party like a smaller government better. Democrats are more narrowly divided: 51% favor a smaller government, but 37% opt for a larger, more activist government.

Sixty-five percent (65%) of liberals chose a government with more services and higher taxes. Eighty-six percent (86%) of conservatives think a smaller government is better.

Sixty-two percent (62%) of all voters say tax cuts are a better way than more government spending to create jobs and fight unemployment. Only 21% say additional stimulus spending is a more effective tool.

Voters overwhelmingly believe that the bigger problem in the United States is the unwillingness of politicians to control government spending rather than voters’ unwillingness to pay enough in taxes. …”

Tea Party Tops GOP on Three-Way Generic Ballot

“…Running under the Tea Party brand may be better in congressional races than being a Republican.

In a three-way Generic Ballot test, the latest Rasmussen Reports national telephone survey finds Democrats attracting 36% of the vote. The Tea Party candidate picks up 23%, and Republicans finish third at 18%. Another 22% are undecided.

Among voters not affiliated with either major party, the Tea Party comes out on top. Thirty-three percent (33%) prefer the Tea Party candidate, and 30% are undecided. Twenty-five percent (25%) would vote for a Democrat, and just 12% prefer the GOP.

  • 79% responded “no,”” it is not doing enough.

It also asked, “Which is more important: securing the border or legalizing undocumented workers?”

  • 65% responded that gaining control of the border is more important.
  • 26% responded that legalization is more important.

Rasmussen Report Poll conducted from October 24-25th of 800 likely voters found that:

  • 51% opposed the DREAM Act (a form of amnesty for former and present illegal alien students) concept
  • 68% believe the passage of the bill would encourage more illegal immigration in the future.
  • 71% believe that illegal immigrants should not qualify for in-state tuition rates at colleges and universities.
  • 77 % oppose making drivers’ licenses available to illegal immigrants. …”

“…An important point about using verification of legal status as a way downsize the illegal population is that its effects would be felt gradually, rather than all at once. A new, functional verification system for employment, for instance, would be applied mainly to new hires (though employers should have the option of checking existing employees as well). The same is true for getting a driver’s license or a mortgage — these are not things people do every day, so the effects of verifying legal status would unfold over a period of time.

Attrition requires not only implementing policies to force illegals to deport themselves, but also avoiding policies that would trigger more illegal immigration. This has two main policy implications: First, streamline the legal immigration system to make it less likely to promote illegal immigration, by eliminating the visa lottery and the preference category for adult siblings of U.S. citizens. And second, under no circumstances undertake any new guestworker programs, the inevitable result of which would be to stimulate even more illegal immigration.

And finally, legalization (i.e., amnesty) isn’t even a legitimate topic for discussion until after the broken immigration system is fixed. Even then, there are strong arguments against it, but it would at least be appropriate to debate it as one possible way to deal with long-term illegal aliens. Until that time, however, even a discussion of legalization (or normalization, or earned regularization, or whatever this week’s euphemism is for amnesty) is irresponsible and subversive of law enforcement.

An effective strategy of immigration law enforcement requires no booby traps, no tanks, no tattoos on arms — none of the cartoonish images invoked in the objections raised routinely by supporters of loose borders. The consistent application of ordinary law-enforcement tools is all we need. “Consistent,” though, is the key word. Enforcement personnel — whether they are Border Patrol agents, airport inspectors, or plainclothes investigators — need to know that their work is valued, that their superiors actually want them to do the jobs they’ve been assigned, and that they will be backed up when the inevitable complaints roll in.

And, finally, this isn’t bitter medicine the public must be persuaded to swallow for the greater good. Enforcement of the immigration law may not be popular among the elite, but actual voters across the political spectrum support it. As Alan Wolfe wrote in One Nation, After All, the difference between legal and illegal immigrants “is one of the most tenaciously held distinctions in middle-class America; the people with whom we spoke overwhelmingly support legal immigration and express disgust with the illegal variety.”

Harnessing that sentiment can buttress a sober, considered policy of attrition through enforcement.”

“…In 2005, Bear Stearns analysts determined that the surveys conducted by the Census Bureau undercounted the number of illegal immigrants by far more than 10%. Through discussions with illegal immigrants, Bear Stearns found that immigrants avoid responding to Census questionnaires and work very hard to conceal their identities.

As an alternative to the residual method, Bear Stearns used micro-economic indicators to project an alternative estimate. Underpinning Bear Stearns’ estimate of 20 million illegal immigrants is the identification of two patterns: 1) a trend of sharply increased demand for public services in communities that have become gateways for immigration, and 2) increases in foreign remittances (money sent back to an immigrant’s native country), housing permits and border-crossings.

Given the unrecorded nature of the illegal immigration phenomenon, it’s unlikely that a well-founded or rigorous method of measurement will be developed. The reality is, the math is fuzzy and the most definitive conclusion one can make is that the measurements of illegal immigrants in the U.S. are subject to extreme inaccuracies.”

Planting the seeds of the next shamnesty

“…The Hill reports that President Obama will “huddle” with Hispanic Democrats tomorrow to talk “immigration reform.”

Translation: The seeds of the next shamnesty are being planted:

Hispanic Democrats will have their first West Wing meeting with President Obama on Wednesday morning to discuss immigration reform, according to Democratic sources.

The meeting is the first face-to-face sit-down between Obama and the Congressional Hispanic Caucus (CHC) since the president was sworn-in. Some in the CHC have recently expressed frustration that Obama has not talked more about immigration in his first two months in office.

Immigration reform is front-and-center on the group’s agenda.

CHC is eager to hear the president’s ideas and proposals for tackling immigration reform, not only as it relates to a comprehensive reform bill that could provide a pathway to citizenship for millions of undocumented workers but also as it relates to rolling back Bush administration policies of raiding workplaces and detaining and deporting thousands of illegal workers.

CHC members came away from a recent meeting in the Capitol with Department of Homeland Security Secretary Janet Napolitano — a day after her Senate confirmation hearing — very encouraged that the workplace raids policy would be fully reviewed, and possibly altered.

Obama is on board. His DHS secretary is on board. The question is not whether, but when. He spoke to the massive illegal alien shamnesty march in Chicago in 2006, where he boasted of standing “shoulder-to-shoulder” with the open-borders mob. Here’s a flashback: …”

Obama’s border talk: I call bull

“…There’s been a bit of a stir over President Obama’s comments suggesting that he is open to the idea of sending National Guard troops down to the southern border to deal with long-festering chaos.

“We’re going to examine whether and if National Guard deployments would make sense and under what circumstances they would make sense,” Obama said during an interview with journalists for regional papers, including a McClatchy reporter.

No meaningful security force will be mobilized along our border.

It will never happen as long as the La Raza/Race lobbyist has a seat at Obama’s table and certainly not as long as DHS is headed by a secretary who is incensed that basic immigration laws are being enforced.

And not as long as the White House is supported and populated by open-borders activists pushing for shamnesty and other illegal immigration-legitimizing measures (hint: Census power grab) designed to boost Democrat voter rolls.

Not going to happen. The state of the borders will remain unsound.

 THE EMPLOYMENT SITUATION:  FEBRUARY 2009

   Nonfarm payroll employment continued to fall sharply in February (-651,000),
and the unemployment rate rose from 7.6 to 8.1 percent, the Bureau of Labor
Statistics of the U.S. Department of Labor reported today.  Payroll employ-
ment has declined by 2.6 million in the past 4 months.  In February, job
losses were large and widespread across nearly all major industry sectors.

   The number of unemployed persons increased by 851,000 to 12.5 million in
February, and the unemployment rate rose to 8.1 percent.  Over the past 12
months, the number of unemployed persons has increased by about 5.0 million,
and the unemployment rate has risen by 3.3 percentage points.  (See table
A-1.)

   The unemployment rate continued to trend upward in February for adult
men (8.1 percent), adult women (6.7 percent), whites (7.3 percent), blacks
(13.4 percent), and Hispanics (10.9 percent).  The jobless rate for teen-
agers was little changed at 21.6 percent.  The unemployment rate for Asians
was 6.9 percent in February, not seasonally adjusted.  (See tables A-1, A-2,
and A-3.)

   Among the unemployed, the number of job losers and persons who completed
temporary jobs increased by 716,000 to 7.7 million in February.  This mea-
sure has grown by 3.8 million in the last 12 months.  (See table A-8.)

   The number of long-term unemployed (those jobless for 27 weeks or more)
increased by 270,000 to 2.9 million in February.  Over the past 12 months,
the number of long-term unemployed was up by 1.6 million.  (See table A-9.)

  • The nation’s immigrant population (legal and illegal) reached a record of 37.9 million in 2007.
     

  • Immigrants account for one in eight U.S. residents, the highest level in 80 years. In 1970 it was one in 21; in 1980 it was one in 16; and in 1990 it was one in 13.
     

  • Overall, nearly one in three immigrants is an illegal alien. Half of Mexican and Central American immigrants and one-third of South American immigrants are illegal.
     

  • Since 2000, 10.3 million immigrants have arrived — the highest seven-year period of immigration in U.S. history. More than half of post-2000 arrivals (5.6 million) are estimated to be illegal aliens.
     

  • The largest increases in immigrants were in California, Florida, Texas, New Jersey, Illinois, Arizona, Virginia, Maryland, Washington, Georgia, North Carolina, and Pennsylvania.
     

  • Of adult immigrants, 31 percent have not completed high school, compared to 8 percent of natives. Since 2000, immigration increased the number of workers without a high school diploma by 14 percent, and all other workers by 3 percent.
     

  • The share of immigrants and natives who are college graduates is about the same. Immigrants were once much more likely than natives to be college graduates.
     

  • The proportion of immigrant-headed households using at least one major welfare program is 33 percent, compared to 19 percent for native households.
     

  • The poverty rate for immigrants and their U.S.-born children (under 18) is 17 percent, nearly 50 percent higher than the rate for natives and their children.
     

  • 34 percent of immigrants lack health insurance, compared to 13 percent of natives. Immigrants and their U.S.-born children account for 71 percent of the increase in the uninsured since 1989.
     

  • Immigrants make significant progress over time. But even those who have been here for 20 years are more likely to be in poverty, lack insurance, or use welfare than are natives.
     

  • The primary reason for the high rates of immigrant poverty, lack of health insurance, and welfare use is their low education levels, not their legal status or an unwillingness to work.
     

  • Of immigrant households, 82 percent have at least one worker compared to 73 percent of native households.
     

  • There is a worker present in 78 percent of immigrant households using at least one welfare program.
     

  • Immigration accounts for virtually all of the national increase in public school enrollment over the last two decades. In 2007, there were 10.8 million school-age children from immigrant families in the United States.
     

  • Immigrants and natives have similar rates of entrepreneurship — 13 percent of natives and 11 percent of immigrants are self-employed.
     

  • Recent immigration has had no significant impact on the nation’s age structure. Without the 10.3 million post-2000 immigrants, the average age in America would be virtually unchanged at 36.5 years.
